Klixd provides digital marketing services specifically for dental and allied health practices. Our services may include, but are not limited to:

• Google Ads campaign setup, management, and optimisation
• Meta (Facebook/Instagram) advertising campaign management
• Landing page design and conversion optimisation
• Google Business Profile optimisation
• Competitor analysis and market intelligence
• Performance reporting and analytics
• Marketing strategy consultation

The specific services provided to you will be outlined in a separate service agreement or proposal before any work commences.

You may use our website for lawful purposes only. When using our website, you agree not to:

• Use the site in any way that violates applicable Australian or international laws
• Attempt to gain unauthorised access to any part of the website, server, or connected systems
• Transmit any viruses, malware, or other harmful code
• Use automated tools to scrape, copy, or extract content from our website
• Submit false or misleading information through any forms or scorecards
• Interfere with or disrupt the website's functionality

We reserve the right to restrict or terminate access to our website for any user who violates these terms.

Our marketing scorecards and free resources are provided for general informational purposes only. They are designed to give you a high-level indication of your practice's marketing position and are not a substitute for professional marketing advice tailored to your specific circumstances.

Scorecard results are based solely on the information you provide and do not account for all factors that may influence your marketing performance. We do not guarantee specific outcomes based on scorecard results or recommendations.

By completing a scorecard and providing your contact details, you consent to us contacting you to discuss your results. You can opt out of further communications at any time.

No setup fees: We do not charge setup fees for new clients. Our pricing is based on a monthly management retainer as outlined in your service proposal.

Ad spend: Advertising spend (paid to Google, Meta, or other platforms) is separate from our management fees and is paid directly by you to the advertising platform. We will recommend an appropriate budget based on your goals and market.

No lock-in contracts: Our services operate on a month-to-month basis. You may cancel at any time with 30 days' written notice. There are no early termination penalties.

Payment: Management fees are invoiced monthly and due within 14 days of the invoice date. We reserve the right to suspend services for accounts that remain unpaid beyond 30 days.

Price changes: We will provide at least 30 days' notice of any changes to our fees. You may terminate the agreement if you do not accept the revised fees.

To deliver effective results, we require your cooperation. As a client, you agree to:

• Provide accurate and complete information about your practice, services, and business goals
• Grant necessary access to advertising accounts (Google Ads, Meta Business Suite, Google Business Profile) as required
• Respond to reasonable requests for information, approvals, or feedback in a timely manner
• Ensure that any content, images, or materials you provide for use in campaigns are owned by you or that you have the right to use them
• Comply with all relevant advertising regulations, including AHPRA guidelines for healthcare advertising in Australia
• Maintain active advertising accounts and ensure payment methods are valid

Delays or failures in meeting these responsibilities may impact campaign performance and timelines. We are not liable for any negative outcomes resulting from inaccurate information or delayed cooperation.

We understand that healthcare practices in Australia are subject to advertising regulations under the Health Practitioner Regulation National Law, administered by AHPRA (Australian Health Practitioner Regulation Agency).

We take reasonable steps to ensure that advertising content we create complies with AHPRA guidelines, including restrictions on testimonials, misleading claims, and the use of titles. However, it remains your responsibility as the registered practitioner or practice owner to ensure that all advertising content meets your regulatory obligations.

We recommend that you review all campaign content before it goes live. We will always provide you with the opportunity to approve ad copy, landing page content, and creative materials before publication.

Our website: All content on the Klixd website, including text, design, graphics, logos, code, and the scorecard tools, is owned by Life Sphere Strategies Pty Ltd and protected by Australian copyright law. You may not reproduce, distribute, or create derivative works from our content without written permission.

Client work: Any custom landing pages, ad copy, creative assets, or campaign materials we produce specifically for your practice become your property upon full payment of related invoices. We retain the right to use anonymised or aggregated performance data for our own marketing and case studies (without identifying your practice, unless you give written permission).

Third-party content: Stock images, fonts, and other third-party assets used in our work are licensed under their respective terms. We will ensure all assets used are properly licensed for commercial use.

While we use industry best practices and data-driven strategies to maximise your marketing performance, we cannot guarantee specific results, including but not limited to:

• A specific number of new patient enquiries or bookings
• A specific cost per lead or return on ad spend
• Specific Google search rankings or ad positions
• Specific revenue or profit increases

Marketing performance is influenced by many factors beyond our control, including your practice's reputation, location, competition, pricing, staff responsiveness, and market conditions. Performance metrics and projections shared on our website or during consultations are indicative and based on typical industry benchmarks, they are not guarantees.

To the maximum extent permitted by Australian law, including the Australian Consumer Law:

• Our total liability for any claim arising from our services is limited to the total fees paid by you to us in the 3 months preceding the claim
• We are not liable for any indirect, incidental, consequential, or special damages, including lost profits, lost data, or business interruption
• We are not liable for any loss arising from platform changes by Google, Meta, or other third-party services beyond our control
• We are not liable for downtime, data loss, or service disruptions caused by third-party hosting, advertising platforms, or internet service providers

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by contract.

By you: You may terminate our services at any time by providing 30 days' written notice via email to hello@klixd.com. You remain responsible for any fees incurred up to the termination date.

By us: We may terminate our services with 30 days' written notice if:

• Your account is more than 30 days overdue on payment
• You breach any material term of these Terms or your service agreement
• You provide misleading information or request advertising content that violates AHPRA guidelines or applicable laws

On termination: We will provide you with access to all campaign data, reports, and assets created during our engagement. Advertising accounts remain yours and under your control at all times. We will remove our administrative access within 7 business days of termination.

If a dispute arises from these Terms or our services, both parties agree to first attempt to resolve the matter informally through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation in accordance with the Resolution Institute's mediation rules.

If mediation is unsuccessful, either party may pursue resolution through the courts of New South Wales, Australia. These Terms are governed by the laws of New South Wales.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

For material changes that affect existing clients, we will provide at least 30 days' notice via email before the changes take effect.
